Welcome to Xposed360. These Terms of Service (“Terms”) govern your access to and use of the Xposed360 website at xposed360.com and the Xposed360 web and mobile application (collectively, the “Service”), operated by Quantum Logic LLC, a Texas limited liability company, doing business as Xposed360 (“we,” “us,” or “our”).
By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old to create an account and use Xposed360. The Service is intended for and available only to users 18 years of age and older, and account creation requires confirmation that you are at least 18. We do not knowingly collect personal information or health data from anyone under 18. By using the Service, you represent that you are at least 18 years old and that any information you provide is accurate.
2. The Service
Xposed360 is a personal wellness tracking application that lets you log daily symptoms and correlates them with environmental data (such as pollen counts, air quality, weather, humidity, and UV levels) at your location. Premium subscribers receive AI-powered pattern analyses.
Xposed360 is a wellness tool, not a medical device or healthcare service. See Section 8 for important medical disclaimers.
3. Your Account
To access most features, you must create an account. You are responsible for:
- Keeping your login credentials confidential
- All activity that occurs under your account
- Providing accurate information during signup and keeping it current
- Notifying us immediately at [email protected] if you suspect unauthorized access
We reserve the right to suspend or terminate accounts that violate these Terms.
4. Subscription and Billing
Subscription Plans
Xposed360 offers the following Premium subscription plans:
- Monthly Premium: $7.99 per month
- Annual Premium: $49.99 per year (saves approximately 48%)
Prices are in U.S. dollars. Taxes and platform fees, where applicable, are added by the Apple App Store or Google Play at checkout. Local prices in other currencies may differ based on Apple’s and Google’s currency conversion and regional pricing.
Where Subscriptions Are Purchased
Xposed360 Premium subscriptions are purchased and managed through the Apple App Store or Google Play, depending on your device. Xposed360 does not sell subscriptions directly and does not process payments. All billing, renewal, cancellation, and refund decisions are made by Apple or Google according to their respective terms and policies.
Free Trial
New subscribers may be offered a 14-day free trial. During the trial, you will have full access to all Premium features. To avoid being charged, you must cancel before the end of the trial period through the App Store or Google Play, as described in our Refund & Cancellation Policy. If you do not cancel, your subscription will automatically convert to a paid subscription at the plan price and billing frequency you selected at signup.
Auto-Renewal
Your subscription will automatically renew at the end of each billing period (monthly or annually) until you cancel. By subscribing, you authorize Apple or Google (as applicable) to charge your payment method on each renewal date at the then-current price. Apple and Google will notify you by email or in-app notice before any price change as required by their policies.
Cancellation
You may cancel your subscription at any time through the App Store or Google Play. To cancel, open the Subscriptions section of your iOS device Settings or the Google Play Store app, locate Xposed360, and follow the platform’s cancellation steps. Detailed cancellation instructions are provided in our Refund & Cancellation Policy.
Upon cancellation, your access to Premium features will continue until the end of your current paid billing period. You will not be charged for further renewals.
Refunds
All refund requests are handled by Apple or Google according to their own policies. Xposed360 does not have the ability to issue refunds directly. See our Refund & Cancellation Policy for details on how to request a refund from Apple or Google.
Payment Processing
All payments are processed by Apple or Google through their respective platforms. Xposed360 does not receive, collect, or store your payment card details, billing address, or other financial account information. See our Privacy Policy for details on the limited transaction information we receive from Apple and Google to manage your Premium access.
5. Acceptable Use
You agree not to:
- Violate any applicable law, regulation, or third-party right
- Copy, modify, reverse-engineer, or create derivative works of the Service
- Use automated means (bots, scrapers, crawlers) to access the Service
- Attempt to gain unauthorized access to any part of the Service, other accounts, or our systems
- Interfere with or disrupt the Service or servers
- Upload or transmit viruses, malware, or other harmful code
- Impersonate another person or entity
- Resell or commercially exploit the Service without our written permission
- Use the Service in any way that could damage, disable, or impair its operation
6. Your Content
You retain ownership of the symptom logs, notes, and other content you submit to Xposed360 (“Your Content”). By submitting Your Content, you grant Xposed360 a limited, non-exclusive, royalty-free license to store, process, and display it for the purpose of operating and improving the Service and providing the features you request (including AI pattern analysis).
You represent that you have the right to submit Your Content and that it does not violate anyone else’s rights.
7. Our Content
The Service — including its design, software, text, graphics, logos, and the Xposed360 name and brand — is owned by Quantum Logic LLC and used under the Xposed360 brand, and is protected by copyright, trademark, and other laws. You may not copy or use our content outside the Service without our written permission.
8. Not Medical Advice
Xposed360 is a general wellness and self-tracking tool. It is NOT a medical device, NOT a clinical decision support tool, and NOT a substitute for professional medical care.
The Service is not intended to diagnose, treat, cure, mitigate, or prevent any disease, illness, condition, or symptom. Xposed360 has not been reviewed, cleared, approved, or evaluated by the United States Food and Drug Administration (FDA), the European Medicines Agency (EMA), or any other medical, regulatory, or licensing authority.
Information provided by the Service — including environmental data, symptom correlations, scores, predictions, and AI-generated pattern analyses — is for general informational and self-awareness purposes only. Patterns, correlations, “drivers,” scores, predictions, and any other outputs are statistical observations, not medical conclusions. They may be incomplete, inaccurate, or misleading. Environmental data is sourced from third parties and may contain errors, delays, or omissions. AI-generated analyses are probabilistic and produced without human clinician review.
Always consult a qualified, licensed healthcare provider about any medical condition, symptom, treatment, medication, or healthcare decision. Do not start, stop, or change any medication, treatment, or medical regimen based on anything you read or see in Xposed360. Do not disregard, delay, or avoid seeking professional medical advice because of information provided by the Service.
If you are experiencing what may be a medical emergency — including but not limited to severe allergic reaction, anaphylaxis, breathing difficulty, chest pain, loss of consciousness, severe symptoms, or thoughts of self-harm — STOP using the app immediately and call 911 (or your local emergency services number) or go to the nearest emergency room.
The Service is not designed for, and you should not use the Service to manage, severe or life-threatening conditions including but not limited to severe asthma, anaphylaxis, severe immunodeficiency, or any condition requiring active medical management.
No Doctor-Patient Relationship. No use of the Service creates a doctor-patient, therapist-client, or any other professional healthcare relationship between you and Quantum Logic LLC, or any of its third-party service providers. The AI models used by the Service are not licensed healthcare providers, do not exercise clinical judgment, and any output that resembles medical advice should be disregarded.
9. Third-Party Services
The Service relies on third-party services (including Apple, Google, OpenMeteo, Anthropic, Render, Cloudflare, and Sentry). We are not responsible for the acts, omissions, or content of third parties. Your use of third-party services is governed by their own terms and policies.
10. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND UNINTERRUPTED OR ERROR-FREE OPERATION.
We do not warrant that environmental data or AI-generated analyses are accurate, complete, or current. Environmental data is sourced from third parties and may contain errors, delays, or omissions. AI-generated analyses are probabilistic and should not be relied on as medical or professional advice.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, XPOSED360 AND ITS OFFICERS, EMPLOYEES, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR $100, WHICHEVER IS GREATER.
Some jurisdictions do not allow limitations on implied warranties or liability, so some of these limitations may not apply to you.
12. Indemnification
You agree to defend, indemnify, and hold harmless Quantum Logic LLC and its officers, employees, and affiliates from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising from your violation of these Terms or your misuse of the Service.
13. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access to the Service if you violate these Terms or if we are required to do so by law. Upon termination, Sections 6, 7, 8, 10, 11, 12, and 14–16 will survive.
14. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any lawsuit arising from or related to these Terms or the Service must be brought exclusively in the state or federal courts located in Travis County, Texas, and you consent to the jurisdiction of those courts.
15. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you by email or through a notice within the Service before the changes take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
16. Miscellaneous
Entire Agreement. These Terms and the Privacy Policy are the entire agreement between you and Xposed360 regarding the Service.
Severability. If any provision of these Terms is found unenforceable, the rest will remain in effect.
No Waiver. Our failure to enforce any provision does not waive our right to enforce it later.
Assignment. You may not assign these Terms. We may assign them in connection with a merger, acquisition, or sale of assets.
